ZVRS’s provision of Video Relay Services (VRS) is governed by the rules adopted by the Federal Communications Commission (FCC) (47 C.F.R. 64.601 et. seq.) pursuant to the FCC’s authority under Section 225 of the Communications Act of 1934, as amended, 47 U.S.C. 225. Under these rules, VRS Communication Assistants (CAs) must meet certain minimum standards in order to qualify as VRS interpreters. While all of ZVRS’s interpreters are qualified to provide VRS under the FCC’s rules, different credentialing and licensing requirements are imposed by each of the individual states with respect to the qualifications needed to provide legal interpreting, i.e., interpreting for depositions and other legal proceedings. Because ZVRS is centrally located in some states, it cannot guarantee that all of its interpreters meet all of the legal interpreting qualifications of every single state. No party shall have the right to rely on such VRS for any specialized interpreting service needs.

911/E911 Calls

ZVRS is not liable for any error during the emergency call process, nor for any delay in the call process or availability of video interpreters. ZVRS is also not liable for any error in the transmission or interpretation of any information pertaining to the emergency, including but not limited to: location, identifying information such as names, nature of emergencies, or any other details shared during the call. Additionally, ZVRS is not liable for any delays or problems with emergency personnel’s arrival or services. ZVRS is also not liable for any damages arising from your failure to provide ZVRS an accurate, up-to-date Registered Location or for your failure to give permission for a ZVRS application to access your device’s location information. For information about how to update your Registered Location, please refer to the “Dialing 911 for Emergencies” section on our website.

 

WARNING: Please be aware the due to inherent technical limitation of some VRS-based 911/E911 calls, automatic transmission of your location information to a 911 emergency call center may not occur. The resulting need to gather this information and convey it to emergency responders manually increases the amount of time for these calls, as well as the risk of error. In situation where you are unable to place a 911 call via VRS, ZVRS recommends you to call 911 with a regular phone and then leave the phone off the hook. The appropriate emergency call center will recognize this and send assistance your way.

Indemnification

Customer agrees that ZVRS shall not be responsible or liable for any claims or causes of action that arise from Customer’s use of ZVRS’ services or products. Further, Customer agrees to indemnify and hold ZVRS and its members, managers, officers, employees, agents, and affiliated entities harmless for all costs, fees, expenses, and damages of any nature whatsoever related to any such claims, including court and arbitration costs, attorneys’ fees, and the costs of other professionals, unless such claims are solely based on ZVRS’s willful misconduct. This provision will continue to apply after this Agreement ends.

Limitation of Liability

In no event shall ZVRS be liable for punitive, reliance, or special damages, or for indirect or consequential damages, including but not limited to lost profits or revenue or increased costs of operation. These limitations apply even if the damages are foreseeable or ZVRS is told they are possible, and they apply to any negligence claim that does not involve willful misconduct or intentional misconduct no matter how that claim is styled or on what legal grounds (such as contract, tort, statute, misrepresentation), it is based on. ZVRS will be liable for no more than the amount of direct damages to the person or property.

Governing Law

This Disclaimer including any actions arising from or pertaining to it will be governed by the law of the State of Texas, without regard to its choice of law rules. This governing law provision applies no matter where Customer resides, or where Customers uses ZVRS’ services or products.

Changes to Disclaimer

ZVRS will update this Disclaimer if the law or our practices require changes to it. Your continued use following the posting of any changes to this Disclaimer means you agree to be bound by the terms of the revised Disclaimer.
